These General Terms and Conditions of Use and Sale (GTC/U) apply to any use of the My Secret Survey website (hereinafter referred to as "the Site") as well as to all mystery shopping services offered by My Secret Survey. By accessing the Site or subscribing to our services, you accept these GTC/U without reservation.

If you do not accept these conditions, please do not use the Site or the services offered therein.

3. Description of Services

My Secret Survey offers mystery shopping services to businesses (hereinafter referred to as "Clients"). Our services include, but are not limited to:

• Conducting anonymous customer satisfaction and experience surveys.
• Analyzing the quality of service of businesses.
• Providing detailed reports on observations made.

4. Access to the Site

Access to the Site is free for all visitors. However, some services may only be accessible upon quotation or through a subscription to our professional services.

We strive to make the Site continuously accessible. However, access may be suspended for maintenance, updates, or force majeure.

5. Ordering Services

a) Ordering Process

Businesses can order our mystery shopping services by contacting us via the contact form available on the Site, by email, or by phone. A commercial proposal will then be established in the form of a quote, specifying the details of the mission, prices, and terms of execution.

b) Acceptance of the Order

The order is considered accepted upon validation of the quote by the Client, by signature or email, which implies acceptance of these GTC/U. Any validated order is firm and final.

c) Right of Withdrawal

In accordance with Articles L221-18 and following of the Consumer Code, the Client has a period of 14 days from the date of contract conclusion to exercise the right of withdrawal, unless the execution of the service has begun before the end of this period with the Client's express agreement.

6. Prices and Payment Terms

a) Pricing

Les prix des services sont indiqués en euros (€), hors taxes (HT) et toutes taxes comprises (TTC), et sont précisés dans le devis fourni au Client avant la validation de la commande. MYS ∞ se réserve le droit de modifier ses tarifs à tout moment, étant entendu que les services seront facturés sur la base du tarif en vigueur au moment de la validation de la commande.

b) Payment

Le paiement des services s'effectue selon les modalités précisées dans le devis (virement bancaire, carte de crédit, etc.). Le paiement doit être effectué dans les délais convenus avec le Client suivant l’émission de la facture.

In case of late payment, My Secret Survey reserves the right to suspend the service provision and apply late penalties in accordance with the legal rates in force.

7. Execution of Services

a) Execution Deadlines

The ordered services will be carried out within the deadlines agreed with the Client, which are specified in the quote. The deadlines are indicative and may be modified in case of unforeseen circumstances.

b) Client Obligations

Le Client s’engage à fournir toutes les informations nécessaires à l’exécution des services. Il est responsable de la véracité et de l’exactitude des informations communiquées à MYS ∞. Toute information manquante ou erronée peut entraîner un retard ou une impossibilité de fournir la prestation, sans que la responsabilité de MYS ∞ ne puisse être engagée.

c) Reports and Deliverables

At the end of the mystery shopping mission, a detailed report will be provided to the Client, in accordance with the terms defined in the quote. The report includes an analysis and recommendations for improving quality standards in terms of customer experience.

8. Liability

a) Site Liability

MYS ∞ s'efforce de fournir un service de qualité, mais ne peut garantir que les informations fournies sur le Site sont exemptes d'erreurs ou d'omissions. MYS ∞ ne saurait être tenue responsable des dommages indirects, consécutifs à l'utilisation ou à l'impossibilité d'utiliser le Site ou les services.

b) Limitation of Liability

Dans le cadre de la prestation de ses services de client mystère, la responsabilité de MYS ∞ est limitée au montant de la prestation facturée au Client, sauf en cas de faute lourde ou intentionnelle.

My Secret Survey shall not be held liable for any delay or non-performance resulting from cases of force majeure (strikes, breakdowns, natural disasters, etc.).

9. Intellectual Property

The Site and its content (texts, images, graphics, logos, etc.) are protected by intellectual property rights. Any reproduction, representation, modification, or exploitation, in whole or in part, of the content of the Site without the express authorization of My Secret Survey is prohibited and constitutes an infringement.

The mission reports, analyses, and deliverables provided to the Client are also protected by copyright. They may not be disseminated, reproduced, or used without My Secret Survey's written consent.

10. Protection of Personal Data

The personal data collected in the context of service provision is processed in accordance with our Privacy Policy available on the Site. 11. Termination

En cas de manquement par le Client à l'une de ses obligations, MYS ∞ se réserve le droit de résilier le contrat sans préavis et sans que le Client puisse prétendre à une quelconque indemnité.

The Client may also terminate the contract in the event of a serious breach by My Secret Survey of its obligations, after a formal notice that has remained ineffective for a period of 15 days.

12. Governing Law and Jurisdiction

These GTC/U are governed by French law. In the event of a dispute concerning the interpretation or execution of these terms, the parties will endeavor to find an amicable solution. Failing that, any dispute will be submitted to the exclusive jurisdiction of the courts of the jurisdiction of My Secret Survey's registered office, unless otherwise provided by law.

13. Modification of General Conditions

My Secret Survey reserves the right to modify these GTC/U at any time. Changes will apply to all new orders placed after their posting on the Site. It is advisable to regularly consult this page to stay informed of updates.
